1. Scope
These General Terms and Conditions (GTC) apply to all orders placed through the Form & Frame online shop at formandframe.art. By placing an order, you agree to these terms. Form & Frame reserves the right to modify these terms at any time; the version in effect at the time of order placement applies.
2. Products
All artworks are original, one-of-a-kind pieces drawn by a pen plotter with real pens on paper. Due to the nature of the plotter process, minor variations between pieces are inherent and part of the artwork’s character. Product images on the website serve as reference; the actual piece may vary slightly in colour and detail.
3. Prices & Currency
All prices are listed in Swiss Francs (CHF) and include VAT where applicable. Shipping within Switzerland is included in the price. Prices are subject to change without notice; orders are charged at the price displayed at the time of purchase.
4. Ordering Process
An order is placed by adding products to your cart and completing the checkout. You will receive an order confirmation by email. The purchase agreement is formed when we confirm your order. We reserve the right to refuse or cancel orders in cases of pricing errors, product unavailability, or suspected fraud.
5. Payment
Payment is due at the time of order. We accept the payment methods displayed at checkout (e.g. credit card, TWINT, PayPal). Payment is processed securely through our payment provider.
6. Shipping
We currently ship within Switzerland only. Orders are typically dispatched within 3–5 business days. Delivery is handled by Swiss Post (Die Post/La Poste). Shipping costs are included in the product price.
7. Returns & Cancellation
Since each piece is a unique original artwork, returns are only accepted if the item arrives damaged or is materially different from the description. Please contact us within 14 days of delivery at formandframe.art@gmail.com with photos of the issue. We will arrange a replacement or full refund. There is no general right of return for custom or one-of-a-kind goods under Swiss law (OR Art. 40a ff.).
8. Liability
Form & Frame is liable for damages only in cases of intent or gross negligence, as permitted by Swiss law. Liability for indirect or consequential damages is excluded to the extent permitted by law. Our liability is limited to the purchase price of the product in question.
9. Intellectual Property
All designs, images, and content on this website are the property of Form & Frame and are protected by copyright. Purchasing a physical artwork does not transfer reproduction rights. The artwork is sold for personal display only and may not be commercially reproduced.
10. Governing Law & Jurisdiction
These terms are governed by Swiss law. The exclusive place of jurisdiction is Zürich, Switzerland, unless mandatory statutory provisions dictate otherwise.
